actually, I have been contacted by a Lawyer for MGA, and told that I will be the lucky recipient of a lawsuit if I sell my LaLas on eBay

That doesn't make sense since there are many people that sell custom Lalas on ebay. Are you sure it was actually the legal team for MGA and not some other customs seller who feels threatened by your work? And if it really is MGA perhaps their problem is that you make them look too much like a real doll with the box and everything. I know someone once got in trouble for selling custom My Little Ponies not because they were selling customs but because they were "copying the packaging". Maybe if you sell them loose without a box they wouldn't mind. Or you could always sell them here.

Well look at it like this...You KNOW you're GOOD when the company feels threatened by your work! And guess what? If you need a venue to sell them, you can do it here or Etsy or Bonanza, etc. If you sell at any of the other places, you can always leave us a link here.

ohhh thankyou girls~ I customize other folks dollys for them all the time~ if one of yours ever wants a trip to the spa, just drop me a line. MGA has a job opening for a designer, well, last time I checked~ I did not bother to apply as I did not meet the listed requirements, namely the required college degree. I just own my own Museum of early fashion, my own federally registered business and have a lifetime experience in fashion...but no, no paper degree. I have sooooooo many ideas, I could never write them all down. I actually see them in my mind, dont have to even think about it. The hardest thing is finding the right materials out here in the real world to make them come to life. I purple fabric I made Candy's overdress from took me over a month to get in the post from Japan~ I looked everywhere for just the right print. It has glitter on it, and flying witches and ghosts~ its awesome in person! And...did I say, I LOVE LALALOOPSYS!!!!!

Companies throw their legal weight around all the time (I have been threatened with a few lawsuits myself, although for very different reasons) but they actually have no legal ground to stand on when it comes to this. What you are doing with your dolls is considered derivative art, which is protected by law. It's called fair use. You are not replicating the copyrighted characters, nor are you advertising these as official MGA products, so you really have nothing to worry about. They most likely wouldn't even follow through with a lawsuit because I'm sure they are fully aware you haven't broken any laws; they're just trying to scare you. Unfortunately, if you don't do as they say, they won't be too fond of you, but even that's not the end of the world. I've been blacklisted by both Microsoft and THQ...they eventually got over it and forgave me for my "indiscretions".

I hate to disagree rikinnison, and zt, but MGA CAN absolutely tell you what you can do with their dolls if you are trying to resell them. You can do what you want with the dolls in your own home, but the moment you try to resell them in ANY forum, you are infringing on their copyrighted product. MGA owns the patent and therefore the right to control their product. Derivative works cannot be be made without the permission of the owner of the copyright-that is the law. If MGA (owner of said copyright) gives you permission to replicate their work, what you are doing would be completely legal. Your creations are beautiful and MGA knows this. They do feel threatened or they would not have had their lawyers contact you. However, just be aware they could sue you. I know others have been sued for doing the similar things. Just have to be careful!

It isn't that she is selling the dolls that could be represented as infringing since people can resell anything they own. People sell custom Barbies and My Little Ponies all the time. Anyways if MGA really had a problem with customs why haven't they gone after any of the other people who customize Lalaloopsy or Bratz. I think the big problem might be the use of the packaging and logos, which are Copyright to MGA. Something similar happened to someone in the My Little Pony customizing community and it was the boxes that was the issue then too. For example, I think if you were to sell this one it would be okay if you used the first picture but if you use the second they could go after you. mlparena.com/Forums/viewtopic/p=3385502.html#3385502

Derivative works cannot be be made without the permission of the owner of the copyright-that is the law. The whole point of fair use is that it makes this very thing legal within certain limits. If she were mass-producing these, there would indeed be an issue, but she only has a few dolls, all of which are unique. And yes, derivative works can be illegal to sell, but there generally is no liability as long as the work displays a sufficient amount of originality (this is how parodies are able to exist). While these dolls are obviously Lalaloopsies, they are very different from the official products, which is clear to anyone familiar with the franchise. Some people will not know the difference, but as long as it is clearly stated that these are unofficial unlicensed works, that issue is avoided. But with that said, Candy Cauldron is rather questionable because she does resemble a pre-existing character and there is the potential of competition because MGA may eventually want to make a big version of Candy Broomsticks. So, selling this doll may in fact be against the law, but I would say that the Lalaloopsy Monsters are legal. They might even be covered by the first-sale doctrine, although I am not sure because it no longer applies when a product has been altered to a certain degree, and these may or may not have reached that degree. Also, Wardah points out something important that I hadn't considered: the packaging. Because the packaging so closely resembles that of the official dolls, there is that potential for competition as well as illusion (someone could see the package and think it's a new Lalaloopsy). That may in fact be why MGA has taken issue with these customs. As such, it may be best to sell only the dolls and then offer to create custom packaging for them. Either that or make it so the packaging blatantly shows that these are NOT official dolls. The latter method is what people normally do with custom Mighty Muggs. And as many people have done in the past with things they weren't supposed to sell, you could simply sell some random item that just happens to come with a free custom Lalaloopsy. Heh. EDIT: It should probably be noted that I am speaking from personal experience and what I have learned from local lawyers/attorneys. Things like this often go on a case-by-case basis and different courtrooms will have different outcomes, even on the exact same cases. Also keep in mind that while I am in confident in your legal standing, nothing said here will prevent a lawsuit, even if you are well within your legal rights. Although they probably won't want to waste their resources, they absolutely can sue you if they want to.

I appreciate everyones thoughts on the subject. I actually asked them to be specific and asked flat out if they had problem with the packaging, and was told "you need to speak with your own lawyer about it". Its no biggie to me really, with the eBay fees and paypal fees, and the costs of my materials, I never made any money on my LaLas, just really like to make them~ now the kids will get them all

Well, I can't believe it!!!! But boy I would say that mga really felt threatened by the awesomeness of your designs!!! What a compliment to you I think that really is. Here they are being so ugly when they really need to concentrate on how to improve the quality of their dolls. Well, I think that everyone here realizes how good you really are and you should keep your head held high!! The good Lord knows I look forward to seeing what you've done to these dolls! Such a shame, you really would be an asset to mga, but instead they consider you a threat. Well if they read this then they need to take note, because I am sure I speak for many when I say that I would love for them to steal you and your ideas up so we could get some great Lalas!!!

I agree with Bama! Your work is outstanding!! You have captured her perfectly! I would love to have a custom made LALA from you. As for MGA, they have NO idea what they are missing out on if they don`t hire you due to a piece of paper. I say apply anyway...show them a portfolio of your designs, then use the collectors here as your references so they can see that you would draw in lots of buyers...you`ll never know unless you try!
